Crimean Tatar Dzhemil Gafarov, illegally detained in the Rostov-on-Don pre-trial detention centre, is not receiving medical care.

The Commissioner for Human Rights of the Verkhovna Rada of Ukraine, Lyudmyla Denisova, announced this on her Telegram channel.

The state of health of a 59-year-old Crimean Tatar, a participant in the "second Simferopol group" in the so-called "Hizb ut-Tahrir" case, Dzhemil Gafarov, has significantly deteriorated. It is difficult for him to attend court hearings, which exhaust him and require more time to recover," she wrote.

According to Denisova, Gafarov has exacerbated kidney disease. He is worried about constant leg cramps, severe heart pain, and pressure surges.

According to the ombudswoman, the management of the Rostov-on-Don pre-trial detention centre No. 5, where the political prisoner is being held, ignores his treatment and does not provide any medical assistance. Any written requests for a routine examination and medication supply go unanswered.

"In November 2021, the defence managed to get Dzhemil Gafarov to take tests, the results of which have not been reported to him so far, despite numerous appeals", - the ombudswoman said.

She stressed that the illegal actions of the pre-trial detention centre violated the Crimean Tatar's right to life, health care, and medical assistance, which are enshrined in Article 2 of the Convention for the Protection of Human Rights and Fundamental Freedoms and paragraph 22 of the Standard Minimum Rules for the Treatment of Prisoners, approved by the UN Economic and Social Council.

  • 25 Crimean Tatar public activists - Ruslan Suleymanov, Alim Karimov, Rustem Sheikhaliev, Mejit Abdurakhmanov, Yashar Muedinov, Bilal Adilov, Dzhemil Gafarov, Riza Izetov, Izet Abdullayev, Asan Yanikov, Shaban Umerov, Mejit Abdurakhmanov, Tofik Abdulgaziev, Seitveli Seitabdiyev, Farkhod Bazarov, Akim Bekirov, Rustem Seitkhalilov, Servet Gaziev, Seyran Murtaza, Erfan Osmanov, Osman Arifmetetov, Remzi Bekirov, Eskender Suleymanov, Enver Ametov, Vladlen Abdulkadirov and Raim Aivazov - are accused of involvement in the Islamic political party "Hizb ut-Tahrir". The party operates without restriction at the level of national laws of many countries, but it is banned in Russia.
  • Most of those arrested are members of the Crimean Solidarity human rights group. Pomerov, Bekirov, Izetov and Aivazov are charged under Part 1 of Art. 205.5 of the Criminal Code ("Organization of a terrorist organization", to life imprisonment).
  • Others are charged under Part 2 of Art. 205.5 of the Criminal Code ("Participation in a terrorist organization", up to 20 years in prison). All defendants in the case were also charged under Part 1 of Art. 30 and Art. 278 of the Criminal Code ("Preparation for the violent seizure of power", up to 10 years in prison).
