Crimeans and residents of ORDLO will not lose Ukrainian citizenship when obtaining Russian passports - Venislavsky

Ukraine does not recognize valid Russian passports that were forcibly issued to Ukrainian citizens in certain districts of Donetsk and Luhansk regions and the occupied Crimea. Therefore, the provisions of the law on multiple citizenship do not apply to such Ukrainians.

This was announced by the People's Deputy from the "Servant of the People", the representative of the President of Ukraine in the Constitutional Court of Ukraine Fedor Venislavsky TV channel "House".

"The state of Ukraine does not recognize the fact of foreign citizenship (in this case Russian), which individuals obtained by force, were forced to do so because of certain threats to their freedom, life, normal existence in the temporarily occupied territories", - he said.

According to the People's Deputy, such actions violate international human rights standards: the Universal Declaration of Human Rights, the Convention for the Protection of Human Rights and Fundamental Freedoms.

"In this case, in our opinion, these documents are insignificant and therefore they do not entail special legal consequences", - Venislavsky added.

The deputy noted that the basic bill on multiple citizenship clearly states that there can be no dual citizenship with the occupying country, the aggressor country.

"That is, a citizen of Ukraine cannot have the citizenship of the Russian Federation at the same time", - he said.

At the same time, Venislavsky stressed that after the deoccupation of Crimea and ORDLO, if citizens declare that they were actually forced to accept Russian citizenship, they will not have any negative consequences.

What is known

  • The Verkhovna Rada of Ukraine has registered a draft law on multiple citizenship initiated by the President and the responsibility for concealing it. The bill "6368" On Amendments to the Law of Ukraine "On Citizenship of Ukraine" on the grounds and procedure for acquiring and terminating citizenship of Ukraine "appeared on the website of the Council on December 2.
  • Compulsory certification in the occupied Crimea as of February 2021 affected 2.5 million Ukrainians, and about 400,000 of our citizens underwent compulsory certification in the temporarily occupied areas of Donbass.
  • Ukraine does not recognize the forced automatic acquisition of Russian citizenship by Ukrainians in the occupied peninsula, and this is not a reason to lose Ukrainian citizenship.
  • The Russian passport, which was forcibly issued by the Russian Federation to the citizens of Ukraine in the Crimea, should be taken as a means to ensure the necessary living conditions for the period of occupation.
